D.R. Horton sold us a house, an arrangement we agreed to based on their estimated completion date of November 1st.
After we sold our own place, they changed it to December 1st. We had to get temporary housing, and before you know it, they say, "December 8th -- or later." Okay, only a few more days, inconvenient, but not TOO big a deal, right? We went into the office to find out what "or later" means, and the woman said, "I don't have anything scheduled for completion before January." We reviewed our contract. The $500 deposit we put down is nonrefundable.
We then noticed just how many paragraphs of the contract are devoted to them pointing out that "the estimated completion date is just an estimate," and that they are not responsible in any way for any delays unless such delays last longer than two years after the original estimation completion date. The contract goes on to clarify that if the buyer chooses not to go forward with the sale for this (or pretty much any other) reason, the "earnest money" deposit is forfeit. In other words, they can say pretty much any completion date they want to make the sale, and when they delay by weeks, months, or even up to two YEARS, and you are thus forced to find an alternative, then they say, "well, hey, we entered this contract in good faith, you're the one in default, not us." Oh, and there is also a clause in the contract in which the buyer signs away his right to sue. So now hopefully you can see the reason for the title of my review.
Yes, all of this was in the contract (although it's such a lengthy contract, that I think it's safe to say that it's not unreasonable of a lay person to overlook such details, in the flood of other information and legalese) and available for us to review. But the bottom line is, they do basically set it up so that they can screw you over and get away with it. The contract has its text, but as DR Horton's own contract points out, there is such a legal and moral concept of good faith, and they clearly don't have it. Our earnest money is forfeit (unless we choose to live out of hotels for God knows how long) and basically becomes a $500 donation to the D.R.
